CHESAPEAKE, Va. (AP) -- A civil liberties group says Chesapeake school officials have rescinded the 10-day suspension of a student for passing around a plastic bag of oregano at school.

The Rutherford Institute says in a news release that school officials no longer plan to expel 13-year-old seventh-grader Adam Grass. His suspension was rescinded Thursday.

Grass' father, Patrick Grass, told The Virginian-Pilot that his son was suspended by Hickory Middle School officials because oregano is a prohibited "imitation controlled substance." He says three other boys also were suspended.

Schools spokesman Tom Cupitt declined to comment to the newspaper on any of the students' cases, citing privacy laws.
