W Va Mom Asks Full 4th Circuit to Hear Lawsuit Challenging State's Immunization Mandate

RICHMOND, Va. -- A West Virginia mother is asking the full 4th U.S. Circuit Court of Appeals to reverse a decision that rejected her lawsuit challenging the state's child immunization law.

In March, a three-judge panel of the Richmond-based appeals court unanimously rejected Jennifer Workman's claim that the law violated her religious rights.

The Rutherford Institute said Thursday that it has filed a petition on Workman's behalf asking the full court to rehear the case and reverse the panel's ruling.

Workman sued after Lenore Pre-K to 8 School refused to admit her daughter without vaccinations against childhood diseases. Along with religious objections, Workman said she was concerned that the vaccinations would cause her daughter to develop autism.
